The short version

The plain-English summary of the deal. The full Terms below are the actual agreement; if anything here conflicts with them, the full Terms control.

What we do. You give us a URL and keywords. Real, geo-targeted people find and engage with your page through real searches. We never ask for logins, site access, or credentials.
How results are measured. We track your keywords with looker.so, an independent rank-tracking service, and give you a live report link. What the tracker records is what counts, for both of us.
The guarantee. If your tracked keyword started between position #2 and #30 on Google and none of your tracked keywords improve within 7 days of your campaign going live, you can ask for a full refund of that campaign. Just email us.
Prefer results over a refund? Tell us. Instead of refunding, we will keep rerunning your campaign at no extra cost until one of your tracked URLs improves.
Started outside the top 30? We sometimes accept strong sites whose keyword is not ranked yet. Same free-rerun promise applies; refunds for those are case by case, because starting from unranked is a harder, less predictable climb.
What we can't promise. Google is not ours. We can't guarantee a specific position, that #1 lasts forever, or any revenue outcome. Rankings move for reasons nobody controls.
Subscriptions. Recurring plans bill until you cancel. Cancel any time before the next billing date and you won't be charged again.
Play it straight. It has to be your site (or one you're authorized to promote), with lawful content. We can decline any campaign and refund you instead.

These Terms of Service ("Terms") govern your access to and use of the RankSurge website and services. RankSurge is operated by Indexsy Consulting Ltd., a company based in British Columbia, Canada ("RankSurge", "we", "us", or "our"). By using the site, purchasing a campaign, or otherwise engaging our services, you agree to these Terms. If you do not agree, do not use the service.

1. The service

RankSurge delivers real, geo-targeted human engagement signals to a web page and set of keywords that you provide, with the goal of improving that page's position in search results. We do not request, require, or receive access to your website, hosting, accounts, analytics, or any login credentials. The service is delivered externally to the public URL you submit.

2. Rank tracking & measurement of record

We measure campaign results using looker.so, an independent third-party rank-tracking service (the "Tracker"). For each campaign we create a tracking report for your keywords and share a live report link with you.

"Starting Position" means the first position the Tracker records for a tracked keyword when your campaign begins. A keyword the Tracker does not find in roughly the top 100 results is treated as unranked.
"Improvement" means any tracked keyword for your order records a position better (a lower number) than its Starting Position at any check during or after the campaign.

The Tracker's recorded data is the measurement of record for determining Starting Position, Improvement, and guarantee eligibility, for both you and us. Rank tracking is inherently approximate: positions can vary by location, device, personalization, and time of check, and occasional gaps or anomalies in third-party data can occur. We will act reasonably and in good faith when reading the data.

3. Eligibility & your responsibilities

You must be at least the age of majority in your jurisdiction and able to enter a binding contract. By submitting a URL and placing an order, you represent that:

you own the page, or are authorized to promote it on behalf of the owner;
the information you provide (domain, keywords, contact details) is accurate and current;
the page and its content are lawful and do not violate any third party's rights; and
your use of the service complies with all applicable laws.

You are responsible for completing the intake form after purchase. We cannot start, and the guarantee clock does not run, until we have the information needed to launch your campaign. You should also avoid removing, redirecting, de-indexing, or materially changing the target page during a campaign; doing so can void the guarantee for that campaign.

4. Campaigns, pricing & payment

Pricing is presented at checkout. Campaigns are sold either as one-time packages (priced per campaign, which may cover one or more keywords) or as recurring plans that bill each period until cancelled. You authorize us and our payment provider to charge your selected payment method for the campaign you purchase, including any recurring charges, until you cancel. You can cancel a recurring plan at any time before the next billing date; cancellation stops future charges but does not refund charges already incurred except as set out in Section 5. You are responsible for any applicable taxes. Payments are handled by a third-party payment provider subject to its own terms.

5. The ranking guarantee

We stand behind the service with the following guarantee, measured by the Tracker (Section 2):

Guarantee window. The guarantee applies if no Improvement is recorded within seven (7) days of your campaign going live. ("Going live" means the date we begin delivering engagement for your campaign, which follows our receipt of your completed intake form.)
Refund remedy. If a tracked keyword's Starting Position was between #2 and #30 inclusive and your order records no Improvement within the guarantee window, you are entitled, on request, to a full refund of the amount paid for that campaign.
Rerun remedy. If you would rather have the result than the refund, tell us: instead of refunding, we will rerun your campaign at no additional cost, and keep working with you, until at least one of your tracked URLs records an Improvement. Choosing reruns does not waive your refund right for that campaign; you may switch to the refund at any point before an Improvement is recorded.
Campaigns starting outside #2 to #30. Where every tracked keyword's Starting Position was #1 (nothing to improve), or was outside the top 30 or unranked (a harder, less predictable climb), the refund remedy above does not apply automatically. The rerun remedy is still offered in good faith, and refunds for such campaigns are considered case by case at our reasonable discretion.
Multi-keyword orders. For orders covering several keywords or URLs, an Improvement on any one tracked keyword satisfies the guarantee for that order. Refunds apply per campaign order, not per keyword.
Recurring plans. The guarantee applies to each billing period's campaign; the refund remedy for a recurring plan is limited to the charge for the most recent billing period.
How to claim. Email hello@ranksurge.us from the address on your order within thirty (30) days of the campaign going live. Approved refunds are returned to the original payment method, normally within 5 to 10 business days.

This guarantee is your sole and exclusive remedy for campaign results. It does not cover positions lost after an Improvement was recorded, and it is void where Section 3's responsibilities were not met (for example, the target page was taken down or de-indexed mid-campaign) or where fraud or abuse is involved.

6. No guarantee of rankings or results

Search engines such as Google are independent third parties that control their own results using algorithms we do not operate. Beyond the limited guarantee in Section 5, we do not and cannot guarantee any specific ranking position, traffic, conversion, revenue, or other outcome, or that any result will be permanent. Rankings can change at any time for reasons unrelated to our service.

7. Chargebacks

If you believe a charge is wrong or a campaign did not deliver, contact us first at hello@ranksurge.us. We honour the guarantee in Section 5 and resolve billing issues quickly. Initiating a payment dispute without first giving us a reasonable opportunity to resolve the issue is a breach of these Terms, and we may suspend service while a dispute is open.

8. Acceptable use

You may not use RankSurge for any page or content that is illegal, fraudulent, infringing, or otherwise prohibited, including content involving malware, deception, or the violation of any law or third-party right. We may refuse, suspend, or cancel any campaign that we believe violates these Terms or exposes us or others to risk, and we may decline service for any reason. If we decline or cancel a campaign for reasons other than your breach, we will refund the unused amount you paid for it.

9. Intellectual property

The RankSurge name, logo, site, and content are owned by Indexsy Consulting Ltd. and protected by applicable laws. We grant you no rights in our marks or materials except to use the site as intended. You retain ownership of the content and materials you provide and grant us the limited rights needed to deliver your campaign. We may reference anonymized campaign results (for example, a keyword and its ranking movement, with no client name or domain) in our marketing; email us if you want a specific result excluded.

10. Third-party services

The service relies on third parties, including our payment provider, hosting and data providers, and the looker.so rank-tracking service, and it interacts with third-party search platforms. We are not responsible for the acts, omissions, availability, or policies of those third parties.

11. Disclaimer

The service and site are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, Indexsy Consulting Ltd. and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to the service. Our total liability for any claim relating to the service will not exceed the amount you paid us for the campaign giving rise to the claim. Nothing in these Terms excludes rights that applicable consumer protection law (including the British Columbia Business Practices and Consumer Protection Act) does not allow to be excluded.

13. Indemnification

You agree to indemnify and hold harmless Indexsy Consulting Ltd. and its personnel from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the service, your content or page, or your breach of these Terms.

14. Termination

You may stop using the service at any time and cancel recurring plans as described above. We may suspend or terminate your access or a campaign if you breach these Terms or for operational, legal, or security reasons. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

15. Governing law & disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in British Columbia, Canada for any dispute that is not otherwise resolved, except where applicable law gives you the right to bring a claim elsewhere.

16. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above, and your continued use of the service after a change takes effect means you accept the updated Terms. The version in effect when you purchased a campaign governs that campaign.

17. SMS messaging terms

By opting in to SMS on our forms, you agree to receive recurring text messages from RankSurge about your rankings, your account, and related services. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to cancel at any time, or HELP for help. Carriers are not liable for delayed or undelivered messages.
